Terms & Conditions of Sale
PRICES
All prices shown in our Buyers Guide are excluding GST. Prices and specifications may change without notice.

FREIGHT
Spare Parts
All spare parts will incur a freight charge, unless the aggregate order value is above our freight-free limit.

Finished Goods
Standard stocked finished goods items with a dealer net value over $3,000 (our normal freight-free limit) are eligible for freight-free delivery to signed-up BA stocking dealers. However, due to increased freight costs, a temporary freight surcharge currently applies to these orders. BA continues to cover a significant portion of the freight cost. These charges are reviewed regularly and are subject to change in response to fuel price fluctuations and carrier rate movements.

Non-stocking dealers will incur freight charges on all finished goods shipped. To be considered a stocking dealer, dealers are required to carry the range of finished goods as outlined in their signed dealer agreement. Reseller freight arrangements are agreed between BA and those resellers for SKU-assigned lines.

Made-to-order finished goods all incur freight charges. Made-to-order products include LS and LK linkage sprayers, front-mount tanks, BAT and CS Series trailer sprayers, grape sprayers, orchard sprayers, and over-row weed sprayers. Standard freight charges for these products are outlined on page 89 of the Buyers Guide, or ask our team. These are maximum charges and are subject to change; alternative arrangements may be agreed between BA and the purchaser, particularly where the destination is near the factory.

Restocking Fee
A restocking fee of 10% will apply to all returned goods. Returns must be pre-approved and in original, saleable condition.

Payment Terms
Payment is due on the 20th day of the month following the date of our invoice. Keeping within these trading terms will ensure that full discounts are retained. All payments are to be sent to the BA Office. Cheques are accepted subject to collection and with full rights of recourse. Interest on an overdue account may be charged at 2.5% per month. On default of payment, the purchaser shall be liable for all costs of recovering the debt.

Credit
Goods for credit will not be accepted unless they are returned within 14 days. Procured and indent goods are non-returnable.

Goods for credit must be sent with a credit request stating our invoice number. The credit value of the returns will be credited less freight; this includes items sent freight free unless the goods are defective or supplied by us in error. An extra charge will be made for goods received in a less than saleable condition. Some products are subject to a restocking fee.

Prior approval must be obtained for all returned goods, and they must be returned with an RMA Reference Number.

Retention of Title and Property Clause
Clause 1. BA shall retain the title in the supplied goods and property until payment is received in full.

Clause 2. In the event of non-payment for whatever reason, the supplier and/or its agents will be permitted to enter without any hindrance the premises to repossess the supplied goods.

Clause 3. Proceeds of any sale of the supplied goods to a third party (customers/clients) shall be the property of the supplier and such funds shall be kept in trust in a separate bank account as the beneficial owner, and such funds shall be used towards full payment of the supplied goods in the event of non-payment for whatever reason by the customer.

Warranty
BA warrants to the original purchaser for a period of 6 months for contractors, 12 months for farmers, and 24 months for spreaders, that any BA product bearing one of our serial numbers will be free from any defects in material, parts, or workmanship.

BA undertakes to repair or replace, for the original purchaser, any part or parts that are deemed by BA to be faulty within the specified warranty period, providing that the equipment has been used for normal purposes only and in accordance with the instructions.

BA does not cover under warranty the following: fair wear and tear, misuse, neglect, abuse, unauthorised modifications or repairs, tampering by unauthorised dealers, freight, travelling time, mileage or telephone calls. For a full list of exclusions, refer to the BA Warranty Policy 2024.

Warranty work may only be carried out by an authorised BA dealer under the express permission of BA. We recommend that if a dealer thinks that a warranty problem has arisen, they tell their customer that a warranty claim will be submitted and not promise a warranty, as the final decision will be made by BA. All warranty claims are to be submitted on the correct BA Warranty Form and accompanied by the faulty part.

Maximum Liability
The maximum liability which is accepted by BA is limited to replacement of faulty goods only. In the manufacture of our goods, every care has been taken, but as the use of the goods is outside our control, the end user assumes all responsibility for the use of the goods, and neither the manufacturer nor any distributor or retailer shall be liable for any loss, damage or downtime resulting from use.

Any advice or recommendation given by BA and its staff is given in good faith and based on the best information available to us, but neither BA nor our staff accept liability arising from following that advice.
